I think software token that you setup with qr or password from page is still "something you know (but it was too long to remember)", not "something you have (like a private key that that was generated on and never left your security key)"

maybe instead of developing all these bend over backwards solutions to deny these data rapists from getting any pleasure out of it, maybe change the law to make them stop doing it in the first place... they are acting on the rules set in the system so change them.
it makes perfect sense. every laptop incoming instantly available that your agents can access without notice (tsa locks), warrant or cause... and do basically whatever they want with it - from simple dump to exchanging entire chips with custom firmware that will keylog your encryption password.
