Creating a National Strategy for AI is not in Article 1, Section 8 of the US Constitution. Therefore, the US Government does not have the power to do it.

This sounds like it falls under article 2 section 3. If it results in legislation, interstate commerce covers a lot.
Time to shut down open source competition and protect that shareholder value, which happens to coincide with national security (i.e. ideological security) interests.
