These policies suck. But it's a company policy. No one is forcing people to work there.
I always find these policies in the same vain of "x is legal, so what can't I do it without getting fired". Well it may be legal but it's against company policy.

Contracts should be fair and reasonable, especially when one side cannot negotiate.
Penalties for breaching terms of a contract should also be proportionate to the damage caused.
What damages are there in the vast majority of cases?
Another view is that "you're being paid to give up these rights". However, if that is the case, are employees being paid for the time they spend on these games?
Terms which are unnecessary as they can't be enforced or are unreasonable as they have no impact on the business are unfair, and, in the UK at least, can be ignored.
