Serious question here: Why not get rid of the closed number and charge a 100% immigration tax to the employer?
Cheap labor would be priced out unless American really cant substitute the imported labor. Employers would encourage employees to get a green card (as opposed to doing everything in their power to keep them chained to the H1B)
What are the negatives (except for the obvious problems of taxes, of course)
