I think its a good thing to bring light on this. I hope this will get both sides to draw up some boundaries for cyber war - at least we might get a relatively peaceful standoff so we can trade with each other.
A standoff is better than all out escalation with increasingly dramatic incursions and dialog where each side loses face, raising political tensions.
We should realize the beneficiaries of cyberwar escalation are the contractor companies coupled tightly to the NSA. I don't think that many hackers are getting rich, comfortable maybe, but not the big bucks.
I guess this means the original photographer is guilty of leaking a secret document to the enemy. Because the secret FISA order classifying this NSA content, by extension classifies the original work, and all documents that include it.
But lets update the technology from when 'right to bear arms' was written ...
If modern arms are cyber-warfare and information flow, then the arms to keep that power in check are computation, math, encryption, anonymity, private messaging, realtime chat, social networks, web graphics ...
So the right to bear arms in todays terms, I would argue, _is_ the right to a) private internet communications between parties and b) public information broadcast to everyone

false logic.. your justifying an actual erosion of freedom based on massive speculation. And you could bring anything into that argument, because it will always be secret and non verifiable.
Another theory is that Stuxnet stopped Iran nuking San Diego.. but that didn't require recording the private communications of everyone on the planet.

I think this happened to David Brooks.. I think the state sponsored 'terror' scheme of putting hackers and journalists away for 10 years for acts of conscience.. has been effective in keeping Journalists in line. Speak out and you too could end up rotting in a cell.

This college dropout did what those at the NSA with PhDs failed to do in their responsibility to ensure that their organisation stayed within the spirit and laws of their mandate.
He did what Brooks failed to do as a journalist, ie. to draw attention to a worrying centralization of absolute power, and abuse of law.
Lets describe Benjamin Franklin, John Rockefeller, Walt Disney as high school dropouts, rather than look at what they achieved.
