I could probably topple one of the companies in which that happened if I took them to court as it would mean them never being able to hire anyone talented again.
The thing is, anyone who tries to sue becomes persona non grata in the industry. Friends at one big SV tech company have both independently told me that they google new hires and any hint of something off, especially a lawsuit or anything legal means instant blacklisting from the hiring committee.
